End User License Agreement

This End User License Agreement ("Agreement") is a legal contract between you ("Licensee," "you," or "your") and WarPulse LLC ("WarPulse," "we," "us," or "our") governing your access to and use of the WarPulse Lightning API, including all associated data, documentation, endpoints, and services (collectively, the "API"). By registering for an account, obtaining an API key, or making any request to the API, you agree to be bound by this Agreement. If you do not agree, you must not access or use the API.

1. Definitions

  • "API" means the WarPulse Lightning API, including all REST endpoints, data feeds, authentication systems, and associated documentation.
  • "API Key" means the unique credential issued to you to authenticate requests to the API.
  • "Lightning Data" means real-time and near-real-time lightning flash data, including latitude, longitude, timestamp, and any derived or associated fields returned by the API.
  • "Application" means any software, service, website, or product you build using the API or data returned by it.
  • "Commercial Use" means any use intended to generate revenue, directly or indirectly, including but not limited to: selling access to Lightning Data or derived data, embedding the API in a paid product or service, using Lightning Data in a SaaS platform, monetizing an Application through advertising, subscriptions, or licensing, or using Lightning Data to inform commercial decisions.
  • "Plan" means the tier you have selected: Pay As You Go (no monthly fee; 5,000 Billable Calls per calendar month included at no charge, then $0.003 per Billable Call, capped at 100,000 per month), Starter ($20/mo or $168/yr), Pro ($80/mo or $672/yr), Ultimate ($200/mo or $1,680/yr), or Supercell ($600/mo or $5,040/yr). The Free Plan has been retired and is closed to new subscriptions; accounts still on it remain governed by the Free Plan terms below until they move to a current Plan.
  • "Billable Call" means the increment by which all Plans measure consumption, and by which Pay As You Go usage is charged. A single request counts as a minimum of one Billable Call. On /v1/flashes, a request counts as one Billable Call per 100 Lightning Data records returned, rounded up: a request returning 500 records counts as five Billable Calls. On the storm cell, radar cell and storm rotation endpoints, a request counts as one Billable Call per 10 records returned, rounded up. On the streaming feed, consumption is measured at one Billable Call per 50 Lightning Data records pushed, which is twice the rate applied to the same records returned by /v1/flashes, reflecting delivery as records arrive and the connection held open for the duration of the session; the remainder carries between batches rather than being rounded up on each, and any remainder outstanding when a session ends counts as one Billable Call. Records replayed to a reconnecting client are measured on the same basis as records delivered live. A request's Billable Call cost is returned in the X-Quota-Cost response header, so it can be verified per request.

2. License Grant

Subject to the terms of this Agreement and timely payment of all applicable fees, WarPulse grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the API solely in accordance with your Plan, this Agreement, and any applicable documentation.

This license does not convey any ownership interest in the API, the Lightning Data, or any intellectual property of WarPulse.

3. Plan-Specific Commercial Use Rights

Your rights to use the API for Commercial purposes depend on the Plan you have subscribed to. These restrictions apply regardless of the volume of data consumed or the number of API keys held.

Pay As You Go accounts may request a Non-Profit License for this Agreement at no additional cost, reviewed and granted at WarPulse LLC's discretion. An approved Non-Profit License raises the included call allowance rather than lifting any commercial restriction, as Commercial Use is already permitted on every current Plan. Request one from your dashboard, or read more about the process at /licensing. The raised allowance applies only once WarPulse LLC has approved the request for that specific account, and expires after the period stated in the approval unless renewed.

Pay As You Go Plan, Commercial Use Permitted

The Pay As You Go Plan includes a license for Commercial Use, subject to the restrictions in Sections 4 and 5. You may integrate the API into revenue-generating Applications, provided that you do not resell or redistribute the raw Lightning Data as a standalone data product. No commercial-use approval is required.

Starter Plan, Commercial Use Permitted

The Starter Plan includes a license for Commercial Use, subject to the restrictions in Sections 4 and 5. You may integrate the API into revenue-generating Applications, provided that you do not resell or redistribute the raw Lightning Data as a standalone data product. No commercial-use approval is required. The commercial-use license the Starter Plan previously required has been withdrawn and no longer applies.

Retired Free Plan, Non-Commercial Use Only

The Free Plan is closed to new subscriptions. Where an account remains on it, the Free Plan is licensed for personal, educational, research, and non-commercial development purposes only, and Commercial Use is not available on it under any license. You may not use the API or any Lightning Data obtained under a Free Plan in any product, service, or context that generates revenue or is intended to generate revenue. If your use is or becomes commercial, you must move to a current Plan first. WarPulse LLC will give notice before Free Plan access ends, after which API keys still on the Free Plan will stop working; the account and its data are retained, and adding a payment method restores access.

Pro Plan, Commercial Use Permitted

The Pro Plan includes a license for Commercial Use, subject to the restrictions in Sections 4 and 5. You may integrate the API into revenue-generating Applications, provided that you do not resell or redistribute the raw Lightning Data as a standalone data product.

Ultimate and Supercell Plans, Full Commercial Use Permitted

The Ultimate and Supercell Plans include the broadest commercial license available under this Agreement. You may use Lightning Data in high-volume, revenue-generating Applications and may redistribute derived or processed data (not raw API output) as part of your own products, provided attribution requirements in Section 6 are met.

4. Restrictions

Regardless of Plan, you may not:

  • Resell, sublicense, or redistribute raw Lightning Data obtained from the API as a standalone data feed, data product, or API service.
  • Share, transfer, or disclose your API Key to any third party. Each key is issued to a single account and must not be embedded in publicly accessible client-side code.
  • Use the API in any application designed to monitor, track, or target individuals without their informed consent.
  • Use the API in systems that may interfere with aviation, maritime, or emergency safety operations without explicit written authorisation from WarPulse.
  • Attempt to reverse engineer, scrape beyond your rate limits, or circumvent any access controls of the API.
  • Use the API in violation of any applicable law, including data protection, export control, or intellectual property law.
  • Represent that Lightning Data is certified, official, or guaranteed for safety-critical use cases.
  • Use a retired Free Plan API key for any Commercial Use as defined in Section 1.

5. Data Source and Accuracy

Lightning Data is sourced from WarPulse's proprietary data pipeline and is provided on an as-is, as-available basis. WarPulse does not guarantee the accuracy, completeness, timeliness, or fitness of the data for any particular purpose. Infrastructure outages, coverage gaps, and processing latency may affect data availability without notice.

The Lightning Data must not be used as the sole basis for safety-critical decisions, including but not limited to aviation routing, marine navigation, wildfire prediction, or emergency dispatch. You assume all risk arising from reliance on the data.

6. Attribution

Where your Application displays Lightning Data to end users, you must include a visible attribution to the data source. Acceptable forms include:

  • "Lightning data: WarPulse Lightning API"
  • "Powered by WarPulse Lightning API" with a link to warpulse.com

Attribution may be omitted in internal tooling, back-end processing pipelines, or Applications where data is not displayed directly to users, provided the underlying source is documented in your internal records.

7. Rate Limits and Fair Use

Your access is subject to the rate limits and monthly call quotas of your Plan. Exceeding these limits may result in request throttling or temporary suspension of your API key. Systematic attempts to exceed limits, share keys across multiple users, or otherwise abuse the API may result in immediate account termination without refund.

WarPulse reserves the right to adjust rate limits with reasonable notice. For enterprise-scale usage, contact us to discuss custom arrangements.

8. Service Availability and Stream Continuity

WarPulse performs maintenance, including software deployments and server restarts, which may briefly interrupt API requests and close open WebSocket connections. We aim to carry out planned maintenance within announced windows and to notify subscribers using the streaming feed.

Availability commitments by Plan. The Pay As You Go, Starter and Pro Plans are provided on a best-effort basis and carry no availability commitment. The Ultimate and Supercell Plans include access to failover infrastructure and a target availability of 95% per billing period. Those Plans also include radar imagery tiles, which cover the continental United States. Radar imagery tiles are a beta feature: they are provided on the same as-is basis as Lightning Data, the availability commitment in this Section does not extend to them, and their interface may change on notice. The Ultimate and Supercell Plans also include storm rotation data, which likewise covers the continental United States only. Enterprise availability is as set out in your separate agreement, and where that agreement conflicts with this Section, your agreement prevails.

Availability is measured per billing period against incidents we have declared as affecting the API, as published on our status page and shown in your dashboard. Time during which the API was affected by an incident scoped to a single machine, while the service remained available, does not count against the target, nor does time attributable to your own configuration, your network, or a suspension arising under this Agreement.

Where measured availability on the Ultimate or Supercell Plan falls below 95% in a billing period, you may request a credit against your next invoice by contacting support within 30 days of the end of that period. Credits are granted at WarPulse's discretion, are applied to a future invoice rather than refunded, and are the sole remedy for failing to meet the target. Except as stated in this Section, we do not warrant uninterrupted availability.

The streaming feed is resumable. Each flash carries a unique, increasing identifier, and a client that reconnects supplying the identifier of the last flash it received will be sent everything that arrived in the interim before the live feed resumes. Used this way, a reconnection following a restart or a network interruption does not cause flashes to be skipped. Replayed flashes are billable on the same basis as flashes delivered live, as they are the same data delivered by the same means.

Continuity of this kind requires your client to record the last identifier it processed and to supply it on reconnection, as described in the API documentation. Where a client does not do so, the feed resumes from the time of reconnection and any flashes occurring during the interruption will not be delivered over the stream. A single catch-up is limited to the maximum number of flashes stated in the documentation; where an interruption exceeds that, the server will decline the catch-up rather than deliver part of it, and the affected period remains retrievable through the historical endpoints within the limits of your Plan.

9. Fees and Payment

The Pay As You Go Plan requires a valid payment method and is billed monthly in arrears for usage above the included allowance, at the rate stated in Section 1; where usage stays within the included allowance, no charge arises. Access to the Starter, Pro, Ultimate, and Supercell Plans requires a paid subscription, billed either monthly or annually through Stripe at your chosen interval. Annual billing is charged upfront at a 30% discount versus the monthly rate and is not available on Pay As You Go. The retired Free Plan requires no payment method and no fees apply to it. You authorise WarPulse to charge your payment method on a recurring basis for the interval you selected. Failure to maintain a valid payment method will result in suspension of API access. Pay As You Go accounts may set an optional monthly spending cap; once estimated charges for a billing period reach that cap, further requests are declined for the remainder of that period and resume when the next period begins. Where a Plan has a monthly Billable Call ceiling, it applies in the same way, whether or not a spending cap is set; the Supercell Plan has no such ceiling. Fees are non-refundable except where required by applicable law, including for any unused portion of a billing period.

You may upgrade, downgrade, or cancel your subscription at any time through the developer dashboard. Upgrading to a higher-tier Plan takes effect immediately, and you will be charged the difference between Plans at that time. Downgrading to a lower-tier Plan takes effect immediately, with your next invoice reflecting the new Plan's rate. Cancellation takes effect at the end of your then-current billing period; you will retain API access through the end of that period, and, consistent with the foregoing, no refund will be issued for any unused portion of it.

WarPulse may change subscription pricing with at least 30 days' notice. Continued use of the API after the effective date of a price change constitutes acceptance.

10. Term and Termination

This Agreement begins when you first access the API and continues until terminated. Either party may terminate at any time: you by cancelling your subscription and ceasing use; WarPulse by providing written notice if you materially breach this Agreement or if your subscription lapses.

Upon termination: your API keys will be revoked, your license to use the API and Lightning Data ceases immediately, and you must delete any cached Lightning Data you hold unless an alternative arrangement is agreed in writing. Sections 4, 5, 6, 10, 11, and 12 survive termination.

11. Intellectual Property

The API, its software, infrastructure, data pipeline, and all WarPulse trademarks are owned by WarPulse LLC. All Lightning Data, processing methods, and service infrastructure are proprietary. Nothing in this Agreement transfers any intellectual property rights to you.

12. Disclaimer of Warranties

THE API AND ALL LIGHTNING DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WARPULSE DOES NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WARPULSE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL WARPULSE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE FEES YOU PAID TO WARPULSE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

14. Governing Law and Disputes

This Agreement is governed by the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any dispute arising under this Agreement shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Indiana. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

15. Changes to This Agreement

WarPulse may update this Agreement from time to time. We will notify you by email or via the developer dashboard at least 14 days before material changes take effect. Continued use of the API after the effective date of any changes constitutes your acceptance of the revised Agreement. If you do not agree with the changes, you must cancel your subscription and cease use before the effective date.

16. Entire Agreement

This Agreement, together with the WarPulse Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and WarPulse LLC regarding the Lightning API and supersedes all prior agreements or understandings. If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force.
